BJC Ltd has achieved a variation of a condition restricting the age of occupants of a flat in Portsmouth. We were approached after officers of Portsmouth City Council, during pre-application discussions, made it clear that they considered that a variation of the condition would be unacceptable. The Council’s concerns were based on the parking provision for the site.
Through careful analysis of the Council’s parking SPD a clear case was presented to the Council which demonstrated that there were no implications for parking in the area from this proposal.
BJC Ltd also discovered that there was a historic legal agreement on the site and requested that this to was amended to remove restrictions on the age of occupants. The Council also agreed with this approach.
This is a good example as to how a case can be successfully progressed despite initial reservations from Council Officers. BJC prides itself on the way in which we develop innovative, pragmatic solutions to planning problems.
