It is now common practise for Local Planning Authorities to seek contributions towards local infrastructure. Those who build in Surrey will know that this can extend to a wide range of items, including in some areas contributions towards highway works, open space, libraries, recycling and education. There is a danger that such contributions are simply paid without justification.
The practice has recently challenged the basis for collecting educational contributions in Elmbridge (based on the requirements of the County Council) and specifically that there is no justification for asking for a contribution towards education when the development is for one bedroom properties, unlikely to accommodate children. The Inspector accepted this challenge and the County and the Local Planning Authority have since removed the requirement for a contribution to education for such accommodation. This typically produces a saving of about £3,500 per residential unit.
